In order to ensure transparency in the processing of personal data, we present the rules of personal data protection in force at www.fooqs.com, established on the basis of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter "RODO").

I. DATA CONTROLLER

The controller, i.e. the entity that decides on the purposes and means of the processing of personal data, is Fooqs Krzysztof Biegała with its registered office in 62-025 Kostrzyn, Wrzesińska 68 St. In matters related to the processing of personal data, you can also contact us by e-mail at: info@fooqs.com.
The Administrator has appointed a Data Protection Officer in the person of Piotr Maćkowiak, whom you can contact at: office@fooqs.com. The Administrator encourages you to contact the DPO with any concerns regarding the processing of your personal data.

II. ACQUISITION OF DATA AND PURPOSE OF PROCESSING

In carrying out our business functions, we process personal data for various purposes and scope, including but not limited to:

Registering an account in the online store without making a purchase - potential customers

Purpose of processing:

- Registering an account with the online store, by filling out a form on the website

Legal basis for processing:

- Article 6(1)(b) of the RODO, i.e. the necessity of processing in order to provide the service in the form of maintaining an account in the online store

Data storage period:

- Until an objection is raised, i.e. a request to delete the account

Registering an account in the online store along with making a purchase - customers

Purpose of processing:

- Implementation of the contract with the customer
- Investigation and defense of claims

Legal basis for processing:

- Art. 6(1)(b) RODO i.e. the necessity of processing for the performance of the contract
- Article 6(1)(f) RODO i.e. realization of the legitimate interests of the Administrator in the form of investigation and defense of claims

Data storage period:

- For the duration of the contract, and after its termination - until the expiration of the deadlines for claims arising from it

Submission of inquiries, complaints and claims by email

Purpose of processing:

To process complaints and claims, and to respond to inquiries and requests made by email

Legal basis for processing:

- Art. 6(1)(b) RODO i.e. the necessity of processing for the performance of the contract
- Art. 6(1)(c) RODO i.e. legal obligation related to handling complaints and claims
- Art. 6(1)(f) RODO i.e. fulfillment of the Administrator's legitimate interests in the form of providing any information related to the fulfillment of its business objectives

Data retention period:

- For 1 year after the warranty expiration date or settlement of the complaint
- For 1 year after responding to an inquiry not related to the warranty or complaint

III. DATA RECIPIENTS

In connection with its operations, Fooqs Krzysztof Biegała will disclose your personal data to the following entities:
(a) state authorities or other entities authorized by law - if it is necessary for the implementation of legal obligations,
b) entities supporting us in our activities on our behalf, in particular: providers of external ICT systems supporting our activities, subcontractors, entities auditing our activities, appraisers, or entities cooperating with the Administrator within the framework of marketing campaigns, whereby such entities will process data on the basis of an agreement with the Administrator and only in accordance with his instructions,
c) to banks - in case of the need to conduct settlements,
d) to an entity providing accounting or legal services - to the extent necessary to ensure fulfillment of legal obligations or to establish, assert and defend claims,
e) companies that dispose of or archive documents and other media - to the extent that the data is stored in hard copy or on such media.

IV. RIGHTS OF PERSONS WHOSE DATA ARE PROCESSED

Any person whose data is processed by the Administrator has the right to:
(a) access to his/her personal data,
(b) rectification of his/her personal data,
(c) erasure of his/her personal data,
(d) to restrict the processing of their personal data,
e) object to the processing of his/her personal data,
(f) portability of your personal data,
g) if the processing is carried out on the basis of consent - withdraw it at any time without affecting the legality of the processing carried out on the basis of consent before its withdrawal.

In addition, the person whose data is processed has the right to lodge a complaint to the supervisory authority, i.e. the President of the Office for Personal Data Protection.


V. DO YOU HAVE TO PROVIDE YOUR PERSONAL DATA?

Provision of data is necessary for the conclusion and performance of sales agreements and settlement of business conducted, as well as for the Administrator to comply with the obligations imposed by law. This means that in order to use the offer of Fooqs Krzysztof Biegała you must provide your personal data.
In the remaining scope (in particular, as part of processing for marketing purposes), providing data is voluntary.

VI. TRANSFER OF DATA TO THIRD COUNTRIES OR INTERNATIONAL ORGANIZATIONS

Data will be processed in the European Economic Area, i.e. as a rule we do not transfer data to third countries. Possible transfer may occur in the context of the IT infrastructure used by the Administrator. In such a case, the transfer will take place only on the condition that appropriate safeguards, as indicated in the RODO, are provided.

VII. PROCESSING OF PERSONAL DATA BY AUTOMATED MEANS

Personal data will not be processed in a manner that leads to automated decision-making that produces legal effects or otherwise significantly affects the persons whose data we process.

VIII. COOKIES FILES

During your visit to our website, data such as e.g. IP address, domain name, browser type are automatically collected. Cookies are used to create statistics, allow us to automatically recognize your computer's IP address on your next visit, and allow us to maintain a logged-in user session. They are also used for advertising purposes to provide users with advertising content tailored to their interests. IX. CHANGE OF PRIVACY POLICY

The Data Controller reserves the right to make changes to the Privacy Policy, after prior notification of the changes and after setting an appropriate time from which the changes to the Privacy Policy of Fooqs Krzysztof Biegała will be effective.
